In a significant legal victory, Halle Berry has emerged triumphant in her ongoing custody battle with ex-husband Olivier Martinez.
Back in the summer, Berry and her ex-husband agreed to attend “co-parenting therapy” to better help them parent their son, Maceo-Robert Martinez. Well, fast-forward to about three months ago, according to court documents obtained by People Magazine, Berry asked the court to intervene in their “co-parenting” agreement, alleging that Martinez was not seeing the co-parenting coach as previously agreed.
That brings us up to the present. According to new and recent court documents obtained by Us Weekly, a judge ruled in Berry’s favor that Martinez has indeed failed to communicate his lack of availability to participate in co-parenting therapy.
“The court is not persuaded by [his] argument that he could not continue co-parenting therapy during the summer because he was traveling abroad and is not tech-savvy,” the court filing reads. “[The] sessions are done by Zoom, and [he] demonstrated an ability to use Zoom for his June session … as well as his ability to have FaceTime calls [with their son] almost every day in the month of July. [He] could have continued coparenting therapy … but unilaterally declined to continue to participate in counseling.”
The court filing continues, “Because [he] did not participate in coparenting therapy in the summer, he stalled the process of moving forward with coparenting therapy.” The judge also stated that Berry’s resulting legal fees “could have been avoided had [Martinez] acted in a timely manner.”
This is a major win for the Academy Award-winning actress, especially since the 58-year-old is seeking sole custody of her son. Back in August, the actress filed documents with the court, seeking sole custody, stating that Martinez’s lack of cooperation with the process has lead to her 10-year-old’s educational and behavior difficulties.
We hope that both parents are able to come to an agreement soon, putting forth the best for their son.
In addition to Maceo, Berry shares a 16-year-old daughter, Nahla, with ex-Gabriel Aubry.
